to approve a protective helmet for motorbike riders as an approved motorbike helmet
1.
Name of Instrument
This instrument is the Road Transport (Safety and Traffic Management) Approval of Protective Helmets for Motorbike Riders Determination 2016 (No 1).
2.
Commencement
This instrument commences the day after it is notified.
3.
Revocation
This instrument revokes DI2015-1, the Road Transport (Safety and Traffic Management)
Approval of Protective Helmets for Motorbike Riders Determination 2015 (No 1).
4.
Determination
I determine that any helmet that complies with any one or more of the following standards and has an identifying mark certifying compliance with that standard is an approved motorbike helmet:
a)
Australian/New Zealand Standard AS/NZS 1698:2006, Protective helmets for vehicle users (AS/NZS 1698);
b)
in the case of a helmet manufactured in Australia-the version of AS/NZS 1698 or Australian Standard AS 1698-1988, Protective helmets for vehicle users (AS 1698-1988) that was in force at the time the helmet was manufactured, or any later version of AS/NZS 1698 or AS 1698-1988;
c)
in the case of a helmet imported into Australia-the version of AS/NZS 1698 or AS1698-1988 that was in force at the time the helmet was imported, or any later version of AS/NZS 1698 or AS 1698-1988; and
d)
United Nations Economic Commission for Europe Regulation No 22 Uniform Provisions Concerning the Approval of Protective Helmets and their Visors for Drivers and Passengers of Motor Cycles and Mopeds Revision 4 of 24 September 2002 (UNECE22.05) and any further amendments to UNECE22.05 approved and published by the United Nations Economic Commission for Europe, or any later version of UNECE22.05.
5.
Disapplication of certain provisions
The following provisions of the above Standards are disapplied:
1.
Those provisions of the above Standards relating to external projections, but only so far as to allow attachment of communication and recording equipment utilising frangible mountings.
2.
Those provisions of the above Standards relating to requirements for visors but only in relation to flip down internal visors where an external visor meeting the requirements is in place.
3.
Those requirements of the above Standards requiring helmets to be accompanied by a brochure or label detailing use and care instructions, but only as far as the user is not required to carry this brochure or label.
6.
Legislation Act 2001, section 47
Subsections 47(5) and 47(6) of the Legislation Act 2001 do not apply to this instrument.
7.
Expiry
This instrument has effect until revoked.
